Terms of Service

1.Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you are under 18, you are not authorized to use the Service.

2.Term and termination

These Terms apply for as long as you use the Service. You may stop using the Service and delete your account at any time. If you are in an active challenge, you remain bound by these Terms as to that challenge until it ends.

We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms.

3.Your account

You sign in with your email address and a one-time code we send you. You are responsible for keeping access to that email secure and for all activity under your account. Provide accurate information and keep it current. One account per person.

Tell us promptly at support@zonestreak.com if you believe your account has been accessed without your permission.

4.What ZoneStreak is

ZoneStreak lets you and your friends join workout challenges and hold each other accountable to a weekly workout goal. You set a shared goal for a challenge (for example, a number of qualifying workout days per week), commit to it, and stay in the game by showing up. The app tracks who is keeping their streak and who is falling behind.

Workouts are verified using data from Apple HealthKit, meaning heart-rate and workout records plus the source information that identifies which app or device recorded them,.

5.Practice points are not money

During this beta, challenges use non-redeemable practice points only. Practice points are a scorekeeping device. They have no cash value; cannot be bought, sold, transferred, redeemed, or withdrawn; do not expire into anything of value; and are not an IOU or a debt owed to you by anyone. Practice points remain our property and may be adjusted or reset as part of operating the beta.

ZoneStreak does not charge entry fees, collect deposits, hold your money, process payments, facilitate settlement between players, or issue payouts of any kind during this beta. There is no real money in the game, and no element of chance: outcomes depend only on your own verified workouts.

If you and other players choose to agree on your own private consequences outside the app, that is entirely between you. We do not record, route, enforce, or take any responsibility for those private arrangements.

6.Paid challenges: fees and refunds

This section applies only when we offer paid challenges. The beta described in section 5 uses practice points only. A paid challenge has an entry fee between $20 and $100, shown before you join and the same for everyone in that challenge, and ZoneStreak keeps 15% of the prize pool as a platform fee.

You can withdraw from a paid challenge for a full refund of your entry fee at any time before it starts.

Once a challenge starts, your entry fee is committed to the prize pool and is not refunded.

We may still refund an entry fee after a challenge starts, at our discretion, if an error on our side loses or miscounts a verified workout, or for injury or illness.

If we cancel a challenge, everyone in it is refunded in full.

7.How challenges work; fairness

A challenge runs for a set period with a shared goal. Whether you keep your streak in a given week depends on whether your verified workouts meet the goal. Challenge mechanics, including any grace weeks, streak rules and how standings are shown, are part of the Service and may change during the beta.

The Service rewards actions within your control (actually doing qualifying workouts), not chance. We may resolve, or decline to resolve, disputes between players at our discretion, and our decisions about challenges and standings are final.

8.Workout verification and anti-cheating

Verification depends on the workout and heart-rate data your device reports through HealthKit, and on the app or device that recorded it. We check that a workout is real, recent, from a trusted source, and not manually typed in, and we remove duplicate copies of the same workout logged by more than one app.

No verification system is perfect. A legitimate workout may occasionally be rejected, for example if your device did not record usable heart-rate data, or the source is one we do not yet trust, and we do not guarantee that every qualifying workout will be counted. Because the beta uses practice points only, a verification error costs you nothing but progress in a game.

Do not cheat, spoof, or falsify workout or health data. We may review submissions, ask for additional information, and disqualify or remove accounts that submit fraudulent data or otherwise abuse the Service. Our decisions are final.

9.Acceptable use

Use the Service only for your own personal, non-commercial use, and follow the law. You agree not to: register more than one account or impersonate anyone; collude with others to manipulate a challenge; scrape, data-mine, reverse engineer, or use bots against the Service; probe, overload, or interfere with the Service or its security; upload harmful, unlawful, or infringing content; or harass, threaten, or share the private information of other players.

We may remove content or suspend accounts that violate these rules.

10.Your content

You are responsible for any content you post (such as a display name or messages). You keep ownership of it, but you grant Goodware Labs LLC a non-exclusive, worldwide, royalty-free license to host, display, and use that content as needed to operate and improve the Service. We may remove content at our discretion.

11.Our intellectual property

The Service, including its software, design, and the "ZoneStreak" name and logo, is owned by Goodware Labs LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the app for its intended personal purpose. All rights not expressly granted are reserved.

12.Third-party services

The Service relies on third parties such as Apple (HealthKit, sign-in, and the App Store) and providers for email, notifications, and hosting. Your use of those services is subject to their own terms, and we are not responsible for third-party services or content.

13.Health and safety disclaimer

ZoneStreak is not a medical, healthcare, or fitness-advice service, and it does not tell you what is safe for you to do. Consult a qualified professional before starting or changing an exercise program. You participate in workouts at your own risk.

14.Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that verification will be accurate in every case.

15.Limitation of liability

To the fullest extent permitted by law, Goodware Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost progress, arising from your use of the Service. Because this beta is free and involves no real money, our total liability to you for any claim relating to the Service is limited to one hundred U.S. dollars ($100).

16.Indemnity

You agree to indemnify and hold Goodware Labs LLC harmless from claims and expenses arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

17.Communications

By using the Service you agree we may send you account- and challenge-related messages (such as sign-in codes, reminders, and results) by email and, if you enable them, push notifications. You can manage notification preferences in the app or in your device settings.

18.Dispute resolution and governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You and Goodware Labs LLC agree to first try to resolve any dispute informally by contacting support@zonestreak.com.

Any dispute that cannot be resolved informally will be settled by binding arbitration on an individual basis, and you and Goodware Labs LLC waive the right to a jury trial and to participate in a class action, to the extent permitted by law. Either party may still seek to protect its intellectual property in court. If any part of this section is unenforceable, the rest remains in effect.

19.Changes to these Terms

We may update these Terms as the Service evolves. We will revise the effective date above, and material changes will be communicated in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
